Rental Agreement, Liability Waiver, DAMAGE FEE CONTRACT (READ VERY CAREFULLY)

It is the responsibility of the person or organization hiring this inflatable equipment to ensure that all possible precautions are taken to avoid injury to people or damage to the Inflatable.
Please ensure that the following Safety Instructions are followed:
1. No food, drink or chewing gum on or around the Inflatable. This will avoid a choking risk and keep the unit clean. (Please note if the Inflatable is collected in a dirty condition then the person hiring it will incur a cleaning charge)
2. Shoes, glasses, jewelry, and badges MUST be removed before using the inflatable to avoid injury to peoples using the equipment and harm to the Inflatable. 3. No face paints, party poppers, colored streamers or silly string to be used either on or near the Inflatable. (Please note these products will cause damage to the Inflatable that cannot be repaired)
4. NO smoking on or around the Inflatable.
5. NO barbeques around the Inflatable.
6. Climbing, hanging or sitting on walls is dangerous and must not be allowed.
7. A responsible adult must supervise the inflatable at all times.
8. Always ensure that the Inflatable is not overcrowded, and limit numbers according to the age and size of Children using it. Try to avoid large and small children from using it at the same time.
9. Ensure Children are not pushing, colliding, fighting or behaving in a manner likely to injure or cause distress to others.
10. No pets, toys or sharp instruments on the inflatable at any time.
11. Do not allow anyone to BOUNCE, SLIDE OR CLIMB OR INFLATABLE OR on the front safety step as this is dangerous.
12. Do not allow anyone to be on the inflatable equipment during inflation or deflation as this is DANGEROUS.
13. Please ensure that Children are not attempting somersaults and are clothed appropriately and that nothing can fall out of their pockets.
14. In the event that the blower stops working, please ensure all users get off the inflatable immediately and calmly. Check your breaker(s) and make sure the blower tube or deflation tube has not come undone or something has not blown onto and is obstructing the blower. In the event that it overheats, or loses power, switch the blower off at the mains, then switch it back on again 1 or 2 minutes later, and it should restart. If it does not, inform us immediately at (252) 617-3258.
15. THE MOST IMPORTANT RULE: DO NOT let children play on the inflatable without Adult supervision. Adult supervision is necessary to enforce these rules for safe operation of the Inflatable.


1. This rental equipment has been received in good condition and will be returned in the same condition (ordinary wear and tear accepted)
2. Customer assumes all responsibility for injuries to persons or damages to property, and agrees to release and hold Epic Parties & Event Rentals harmless for any and all claims, of whatsoever nature, arising out of use of the rental equipment while in his/her custody. In the event that the release and hold harmless as contained herein is held unenforceable for any reason, the customer hereby agrees to a limit on any damages claimed by Customer to the total paid to Epic Parties & Event Rentals for the rental.
3. The customer agrees that company employee has the right to enter premises of customer at anytime to repossess any and all equipment.
4. Customer agrees to reimburse Epic Parties & Event Rentals. for all attorney fees, an amount not less than 100% of all sums due, court cost and expenses incurred by Epic Parties & Event Rentals. to enforce collection or to preserve or enforce rights under this contract.
5. Customer agrees not to loan, sublet or otherwise depose of equipment or use it at any other location.
6. Customer agrees to pay in full the replacement cost, including labor, for all damages to rental equipment.
7. If the inflatable equipment is lost, stolen, or damaged beyond repair the renter agrees to pay a minimum of $4000.00(four thousand dollars and 0 cents)
8. Customer is responsible for all users of rental equipment until unit is picked up. We will notify customer 48-72hrs of any damage/ additional fee once the unit is clean/ inspected. (Especially for Night Pick ups when visibility is limited).
9. THERE ARE NO WARRANTIES OF MERCHANTABILITY OR FITNESS EITHER EXPRESSED OR IMPLIED. The person(s) or organization renting this Equipment from Epic Parties & Event Rentals will be held responsible and liable for any and all damage or injury occurring for any reason whatsoever. I have read the above agreement and fully understand and accept the conditions as above. I am aware that while in my care I am fully responsible for the inflatable and will pay for any loss or damages that may occur.



RUST Water or MUD/MUDDY cleaning FEE will be an Additional $150 cleaning fee per unit on wet units.

General rules to follow during use of inflatable ride:

Only compatible age groups and similar sized children shall play on the inflatable at the same time.

All riders must remove shoes before entering the inflatable.

No flips or rough play are allowed. On slides make sure riders slide down on bottom, and feet first.

As the Lessee of the inflatable unit, the Safety of all Riders is your RESPONSIBILITY

Absolutely no silly string, gum, candy, food or drinks allowed. If upon Pick-up, such cleaning is warranted an initial charge of $99 to clean inflatable will apply.

DO NOT MOVE the inflatable unit from where Epic Parties & Event Rentals personnel installed it. If the inflatable needs to be moved contact where Epic Parties & Event Rentals 252-617-3258 if we do not answer there is an emergency number on the service to contact.

Special Instructions:

The inflatable is safe and reliable. Should the Inflatable begin to deflate, please proceed to the entrance of the inflatable and assist children exiting first. After everyone is out check for the following issues:

  1. The blower stopped - Check and make sure the cord is plugged into the outlet or the extension cord hasn’t come unplugged. If everything is still plugged in check the GFI breaker on outlet (if applicable) or check the electrical panel for a tripped breaker.
  2. Blower still running - Check the air intake on the side of the blower to make sure it is not blocked by debris. On most inflatable there are 2 chutes on the back. Make sure one chute is snug around blower and the other is tied of tight and no air is escaping. Tighten if necessary. Also check to see if inflatable is damaged in anyway.
  3. If neither of the above recommendations corrects the problem contact Epic Parties & Event Rentals 252-617-3258

SAFE OPERATION ACKNOWLEDGEMENT:

Lessee acknowledges that he/she has been instructed about and fully understands the safe operation of the inflatable unit that is subject of this rental agreement. Lessee agrees to observe all safety regulations and precautions. Lessee also represents and warrants the safe return of the inflatable and associated equipment. If equipment is not returned lessee agrees to pay full replacement cost of items not returned. Also there is a minimum of $250 fee for any repair to inflatable due to lessees negligent.

No Alterations or attachments will be made to the inflatable unit.

Warranty:

Lessor warrants that the inflatable leased under this rental agreement will be in good working order on the effective date of this agreement. The inflatable unit is supplied and maintained subject to this warranty. Lessor is obligated under this rental agreement is limited to repair or replacement of the inflatable when lessor determines that it does not conform to this warranty. This warranty is in lieu of any and all other warranties expressed or implied, and of any and all obligations and of all liabilities on the part of the lessor for damages, including, but not limited to consequential damages arising out of or in connection with the use or performance of the inflatable.

Title to Jump:

Lessee agrees to keep the inflatable unit in his/her custody and not to sublease, rent, sell, or move from delivery location.. The inflatable will remain the property of the lessor and may be removed by lessor at any time after the termination of this rental agreement.

Release of Liability:

The lessee shall be in charge of the inflatable units operation and any other rental equipment, and is fully responsible for its operation as well as return of all equipment. Lessee is fully responsible for its operation as well as return of all equipment including the inflatable unit and all other rental equipment in working order. Lessor and its officers, employees and agents is/are not responsible for injury occurring to the lessee or to any other person using the inflatable or any other rental equipment supplied by Innovative Inflatables. The lessee further agrees to hold the lessor and its officers, employees and agents free and harmless against any injury or claim. The lessee shall indemnify the lessor and its officers, employees and agents from/against any cost incurred due to claims from anyone and for attorneys fees and related cost involving the use and return of the inflatable or other rental equipment, should legal action become necessary.

Entire Agreement:

The rental agreement constitutes the full agreement between lessee and lessor. Time is of the essence in this rental agreement. There will be a $50 fee for returned checks.

Inclement Weather/Rain Policy:

During periods of severe weather conditions, we reserve the right to cancel your reservation. If you need/choose to cancel due to weather related conditions, your deposit will be used towards future rental. That charge can be used towards another rental for up to one year from the event date cancelled.

Warning!

Never leave inflatable running unattended. Do not allow children to supervise the use of the inflatable. Lessee acknowledges that he/she has been fully instructed as to the operation and safety procedures of the equipment rented. Never touch hot or moving parts on any equipment. Never fill generators while in operation or engine is hot.
